Open Letter to Governor Jared Polis: Investigate Corruption in Colorado’s 7th Judicial District

Dear Governor Polis,

As a national advocate for family court reform, I have spent years bearing witness to the systemic failures within our nation’s family court system. The injustices I have encountered are deeply troubling, but what I am seeing unfold in Colorado’s 7th Judicial District is particularly egregious. As the Governor of Colorado, you hold a unique responsibility in this matter. Because judges in Colorado are appointed, the integrity of the judiciary ultimately rests in your hands. I implore you to act swiftly and decisively in the case of Christine McGinley, whose son remains in grave danger due to corruption and judicial misconduct in the court system.

For over a decade, Christine has fought tirelessly to protect her child. Her ex-husband has concerning history that includes domestic abuse and an admission of molesting a four-year-old child. Despite overwhelming evidence, including 35 warnings from medical professionals, reports of neglect, and repeated injuries, the courts have ignored the facts and awarded him primary custody. Equally disturbingly, Christine has faced severe retaliation for her efforts to protect her child. Her constitutional right to a fair trial has been stripped away, and her ability to protect her son has been systematically dismantled by a court system that appears more invested in protecting itself than the children it was designed to serve.

Investigative reports from Hannah Dreyfus of ProPublica and veteran journalist Wayne Dolcefino have unearthed damning evidence of corruption within Colorado’s 7th Judicial District. These investigations have exposed judicial conflicts of interest, collusion between court officials and child welfare agencies, and blatant disregard for due process. Yet, despite these shocking revelations, no meaningful action has been taken to correct these injustices.

Christine’s case is not an isolated incident; it is symptomatic of a larger, deeply entrenched problem within Colorado’s family courts. However, this case is unique in that the corruption has been well-documented, well-investigated, and publicly exposed, yet it persists. If judges and officials are allowed to act with impunity even in the face of such overwhelming evidence, what hope is there for other families suffering in silence?

Governor Polis, the people of Colorado and indeed, the nation, are watching. The responsibility to restore justice in this case and hold those in power accountable now lies with you. An overwhelming number of professionals have expressed concern for this young child. I urge you to take immediate action by:

  1. Launching an independent investigation into the corruption and judicial misconduct in the 7th Judicial District.

  2. Ensuring Christine’s case is transferred to Denver County to allow for a fair and impartial trial.

The safety of a child hangs in the balance. The integrity of Colorado’s judiciary is at stake. The world is watching to see whether justice will prevail or whether corruption will continue to dictate the fate of vulnerable children.

I respectfully request your urgent attention to this matter and look forward to your response.

Sincerely,

Tina Swithin
